These terms govern the use of aulaxis.com and the contracting of Aulaxis technology services. By using the site or contracting a service, you accept these conditions.
1. Identification
Grupo de Soluciones Creativas SAC, taxpayer ID (RUC) 20607431117, domiciled at Las Almendras 286, San Martín de Porres, Lima, Peru, owner of the Aulaxis brand (“Aulaxis”).
2. Purpose
To govern access to the site and the general conditions of our implementation, SaaS, Cloud, migration, support, plugin and custom software development, integration, learning content, proctoring, video conferencing and video, transactional email and consulting services.
3. Contracting and quotes
Each service is contracted through a quote or proposal accepted in writing, which defines scope, timelines, deliverables and price. Quotes are valid for the period stated in each document.
4. Scope and scope changes
Only what is described in the accepted proposal is included. Any change is assessed, quoted and approved in writing before execution.
5. Prices, taxes and payments
Prices are stated in Peruvian soles (PEN) or US dollars (USD), according to each proposal, and indicate whether taxes are included. We accept bank transfer and PayPal. Payment terms are detailed in each contract.
6. Cloud and SaaS services
Availability, backups and support are governed by the service levels (SLA) agreed in each contract. Aulaxis may schedule maintenance with reasonable prior notice.
7. Third-party software and Moodle
Aulaxis provides services on open-source software such as Moodle and Chamilo, subject to their own licenses. Aulaxis is an independent provider and is not affiliated with Moodle Pty Ltd.
8. Intellectual property
Code custom-developed for a client belongs to the client once paid. Aulaxis retains its prior tools, components and know-how.
9. Client content and personal data
The client is responsible for the content it uploads to its platform. Aulaxis processes personal data in accordance with its Privacy Policy and Peruvian Law No. 29733.
10. Support, suspension and termination
Support is provided 24/7 via WhatsApp, phone and email according to the contracted plan. Aulaxis may suspend a service for non-payment or use contrary to the Acceptable Use Policy, with prior notice.
11. Limitation of liability and force majeure
Aulaxis is not liable for indirect damages or for failures caused by third parties or force majeure events. [TO BE CONFIRMED: liability cap with legal counsel]
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Peru. Disputes are submitted to the judges and courts of Lima.
